These Terms of Service ("Terms") govern your access to and use of the services provided by llmair ("we", "us", or "our"), including the website at llmair.ai, the API at api.llmair.ai, and any related software, dashboard, or documentation (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to enter into a binding contract to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to that organization.

2. Account and API Keys

  • You must provide accurate, current, and complete information when registering and keep it updated.
  • You are responsible for safeguarding your password and any API keys. Treat API keys like passwords; the plaintext is shown only once at creation.
  • You are responsible for all activity that occurs under your account and any API key issued to you.
  • Notify us immediately at support@llmair.ai if you suspect any unauthorized access.
  • We may suspend or terminate accounts that contain false information or remain inactive for an extended period.

3. Plans, Tokens, and Billing

We offer a free tier and paid subscription plans (Basic, Pro, Enterprise, and Unlimited), each with a monthly token quota and a corresponding per-model request rate limit. Current pricing and included quotas are published on our Pricing page.

  • Subscriptions are billed monthly via PayPal and renew automatically until canceled.
  • Token top-ups are one-time payments credited to your balance and never expire.
  • Overage: Usage beyond your subscription's monthly quota is automatically billed against your token balance at the per-model rate published on the Pricing page.
  • Welcome bonus: New accounts receive a one-time token credit, as published on the Pricing page.
  • Taxes: Prices are exclusive of any applicable taxes, which may be added at checkout where required by law.
  • Refunds: Subject to our Refund Policy.

4. Acceptable Use

You agree not to use the Service to:

  • Generate, distribute, or facilitate content that is illegal, harmful, harassing, defamatory, obscene, or infringing on intellectual property rights;
  • Produce malware, spam, phishing material, or content intended to deceive or harm others;
  • Generate content that exploits minors in any way;
  • Attempt to circumvent rate limits, quotas, or paywalls;
  • Resell or sublicense access to the Service without our written consent;
  • Reverse-engineer, decompile, or attempt to extract source code from our systems (except as permitted by law);
  • Use the Service to build competing model offerings or to train derivative AI models without authorization;
  • Violate any applicable law or regulation.

We reserve the right (but have no obligation) to monitor usage and to suspend or terminate accounts that violate this section.

5. Rate Limits and Fair Use

Per-minute request limits ("RPM") are enforced per API key based on your subscription tier. Excessive usage or automated scraping may trigger temporary throttling or account review. We will use commercially reasonable efforts to notify affected users before applying throttling.

6. Intellectual Property

The Service, including all software, branding, design, and documentation, is owned by llmair or its licensors and is protected by intellectual property laws. You retain ownership of the content you submit to the Service (your "Input") and of the model's output generated for you (your "Output"), to the extent permitted by applicable law. You grant us a limited license to use Inputs and Outputs solely to operate the Service for you.

7. AI-Generated Content Disclaimer

The Service provides access to third-party AI models. AI-generated outputs may be inaccurate, incomplete, biased, or otherwise unsuitable for your purposes. You are solely responsible for reviewing and validating any Output before relying on it. Outputs do not constitute professional advice (legal, medical, financial, etc.) unless independently verified.

8. Service Availability

We aim for high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, upstream provider outages, or causes beyond our control. Scheduled maintenance will be announced in advance when feasible.

9. Suspension and Termination

We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms, pose a security or fraud risk, or if required by law. You may terminate your account at any time by contacting support@llmair.ai. Termination does not relieve you of payment obligations for amounts already due.

10. Disclaimers and Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL LLMAIR, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR GOODWILL, RESULTING FROM YOUR USE OF THE SERVICE.

IN ANY CASE, OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100).

11. Indemnification

You agree to defend, indemnify, and hold llmair harmless from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from (a) your use of the Service, (b) your violation of these Terms, or (c) your violation of any third party's rights.

12. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date reflects the effective date. Material changes will be communicated by email or by a prominent notice on the Service. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms will be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.
